Synopsis

IRMA AGM followed by a talk.

The Competition and Markets Authority (CMA) is given new powers by the recent Digital Markets Competition and Consumers Act 2024.

This is an antitrust and consumer protection legal tool giving the CMA direct enforcement powers whenever they assess that either competition principles or consumer rights have been breached. Prior to the Act, the CMA would have had to take a case to court. Now, they will impose measures directly on the business. New areas where direct enforcement and monitoring action may be noticed by everyday online traders and other digital enterprises include fake consumer reviews, pre-contractual information for subscriptions and saving schemes and detailed information about algorithms employed. Strengthened antitrust measures will include designation of firms with a so called "strategic market status" and direct imposition of a range of pro-competition measures and market conduct requirements. These may have a very immediate and concrete impact on digital business models.

Attendees will learn what investigatory, monitoring and enforcement powers digital enterprises can expect from a newly empowered Digital Markets Unit at the Competition and Markets Authority. They will appreciate how the CMA will assess a so called "adverse effect on competition" and "strategic market status" and the range of pro-competition measures the CMA has the power to impose.

About the speaker

Chiara Rustici

Chiara Rustici is an independent academic, data regulation analyst and Data Protection Officer as-a-service.

Having held research and teaching posts in Jurisprudence at the Universities of Genoa, Milan and Edinburgh, and having served as Chair of the Law Specialists Group at BCS, The Chartered Institute for IT, and as part of the BCS governance team, Chiara Rustici is currently guest lecturer on IT Law for Computer Science undergraduates at City, The University of London.

She sits on the editorial board of the Journals Frontiers in Blockchain and Journal of Data Protection and Privacy.

She has published extensively on legal reasoning for Computer Law Review International, Bloomberg, O’Reilly, Ragion Pratica, and Contemporary Political Theory. More recently, Dott. Rustici has delivered keynotes at numerous international conferences on how businesses should prepare for the GDPR. Dott. Rustici’s interviews on the impact of the GDPR on specific sectors have appeared in The Times, The Guardian, The Lancet, A.M. Best Newswire, and IT Now. In 2019 she was recognised by her peers in the inaugural DPO200 list compiled by the Swiss-based GDPR Institut as one of the “individuals who have made significant contributions to the privacy and security sectors”. The awarding body considered several factors in compiling this list, including, social media impact, knowledge sharing and community support.
