SYNOPSIS
Efficient and effective supply chains impact the success of a project and business. Materials are sourced and moved around the world in today’s global trade. The cornerstone of a working supply chain is the contract between vendor and buyer that defines the obligations and liabilities of respective parties along the chain. There are a vast amount of documents that give contractual effects including purchase orders, performance specifications, commercial invoices, bills of lading, delivery confirmation, shipment records, regulatory certificates and insurance papers. The cross-border nature of the global supply chain complicates matters.
With the different types of parties involved (for example manufacturers, raw materials suppliers, logistic providers, distributors, end-users) and the amount of paperwork generated, the supply chain process can be time-consuming, an easy target for fraud and is prone to human errors.
Blockchain, a distributed ledger technology, is a digital platform that keeps the whole history of all transactions between users across a network accessible only to the parties involved. Once added to the platform, information cannot be deleted or changed. The immutable nature of the platform, the transparent records of exchanges and the processing power of computer technology, blockchain offers an improvement of traceability, security, accuracy and productivity.
This lecture highlights the legal issues arising from the use of blockchain technology in supply chains, including responsibility and control, performance assurance and liability, jurisdiction, choice of governing law, disputes resolution, the enforceability of underlying contracts, regulatory compliance, blockchain due diligence, intellectual property and data privacy. The resulting business implications will be discussed. Future development and application of technology in managing supply chains will be suggested considering the legal issues identified.

SPEAKER BIOGRAPHIES
Dr Alan Ma is dual-qualified in Engineering and Law. Since the authoring of a non-linear finite element analysis programme as part of his PhD research, Alan has been applying computer technology in various industries including Computer-Aided Design in offshore structures, management of contracts and legal practices. He has been a full professional member of the BCS, The Chartered Institute for IT, since 2004.
Alan handled suppliers’ disputes. He publishes articles on the legal issues in supply and purchase contracts extensively. In early 2019, he investigated the appointment of companies in Shenzhen, China for the development of an innovation hub for technology in legal practices.
